Terms of Service: Section [X] – Prohibition on Automated Access and Scrape Harvesting
1. Restricted Actions
You agree not to modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from this Website. Additionally, you are strictly prohibited from engaging in any of the following activities on or through the Website:
- Automated Extraction: Using, operating, or launching any automated system, including but not limited to “robots,” “spiders,” “offline readers,” “scrapers,” “crawlers,” or “data mining tools,” to access, isolate, download, harvest, or extract data, product descriptions, images, or pricing information from the Website.
- Database Aggregation: Systematically retrieving, compiling, or collecting data or other content from the Website to create or compile, directly or indirectly, a collection, compilation, database, or directory, whether for public or private use, without express written permission from the Website owners. - Circumvention: Bypassing, disabling, or interfering with security-related features, bot-detection software, rate-limiting protocols, or any technical measures employed by the Website to prevent or restrict the copying of content or data. [1, 2]
- Reverse Engineering: Accessing or using backend application programming interfaces (APIs), JSON data streams, or dynamic network calls generated by the Website for the purpose of reverse-engineering proprietary data structures or pricing algorithms. [1]
2. Remedial Action and Liquidated Damages
Any unauthorized use of automated tools, data extraction, or scraping scripts constitutes a material breach of these Terms of Service. The Website owners reserve the right to immediately terminate network access, block offending IP addresses, and revoke registration privileges without warning.
Because the actual damages resulting from unauthorized data aggregation and competitive scraping are difficult to quantify, you agree that you will be liable to the Website owners for liquidated damages in the amount of $100.00 CDN per individual data record or page scraped, which you agree is a reasonable forecast of damages and not a penalty. This remedy is in addition to, and not in lieu of, any other legal or equitable remedies available under the law.
